What Qualifies as a 1031 exchange?

To qualify for a 1031 exchange, a property must meet four basic rules:

  1. Be held for an investment or used for productive purposes in a business.
  2. Be exchanged with a like-kind property (any other type of real estate).
  3. Investor must identify replacement properties for the one being exchanged within 45 days.
  4. Exchange transaction must be completed within 180 days.

While it’s not possible to exchange a principal residence, a recent court ruling has clarified rules that make it possible to exchange a second home or a vacation home, Brown said.

The property must meet these requirements: The owner has held the property for at least two years; rented the property for at least 14 days per year at fair market value; and used the property personally for no more than 14 days of each year.

Landlords may enter a tenant’s unit in case of emergency, to make repairs, decorations, alterations, or improvements, supply necessary or agreed services, exhibit the dwelling to prospective or actual purchasers, mortgagees, tenants, workmen or contractors to make a pre-termination inspection when the tenant has abandoned or surrendered the unit or with a court order. Entry must be during normal business hours, unless an emergency exists or the tenant consents at the time of entry.

There are a few exceptions to the written notice requirement:

  2. if the tenant has abandoned the premises
  3. if the landlord wants to show the unit to a prospective or actual purchaser. What is the Housing Rescue Bill

The primary purpose of the Housing Rescue Bill (passed by the Senate at the end of July 2008) is to help 400,000 homeowner avoid foreclosure. The bill is also meant to strengthen government-sponsored mortgage buyers Fannie Mae and Freddie Mac.

The bill includes a tax refund for first-time homebuyers worth up to 10% of their home’s purchase price with a max of $7500. That’s the upside. The downside is that down-payment assistance programs for FHA (Federal Housing Adminstration) loans may be unavailable after October 1, 2008. Also for FHA loans, the minimum down payment will rise from 3% to 3.5% for new loans. Consult an account if you think this might affect you. Make sure to speak with a mortgage banker who understands FHA loans because until a few months ago they were almost unheard of in San Francisco. Don’t Skimp on Homeowners’ Insurance

Buyers who try to save money by cutting back on their homeowners’ insurance coverage could regret it, a new study warns.

United Policyholders, a San Francisco consumer organization, analyzed the aftermath of last fall’s forest fire in California. The group’s research found that 75 percent of fire victims didn’t carry enough insurance to cover their losses.

California Insurance Commissioner Steve Poizner says his department believes that the insurer has some responsibility for making it clear how much insurance a homeowner needs to buy in order to replace a home that is totally destroyed. So far that view hasn’t been supported by court decisions stemming from lawsuits by unhappy customers whose insurance came up short.

Insurance companies say it isn’t their fault that customers don’t buy enough insurance. “Insurance companies do provide information and options and analysis about rebuilding costs,” says Sam Sorich, president of the Association of California Insurance Cos. “But ultimately the decision about how much insurance to buy is the homeowner’s. That’s the practical explanation and also the legal explanation.”

Better Terms Coming for Jumbo Loans

Great article from today’s news: Executives from Fannie Mae and Freddie Mac told Congress on Thursday that they are reducing interest rates on some jumbo mortgages.

They said their more aggressive purchases in recent weeks of loans between $417,000 and $729,750 have brought rates down.

Prices still remain relatively high compared to rates for lower amounts because investors believe borrowers will refinance as soon as rates decline.

HSH Associates, a financial publisher in Pompton Plains, N.J., said its surveys showed the average rate last week for a 30-year fixed-rate mortgage of $417,000 or less eligible for sale to Fannie or Freddie was 6.17 percent. The average for such loans of between $417,000 and $729,750 was 6.61 percent, or 0.44 of a percentage point higher.
